End User License Agreement

Introduction
This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and oleander ("oleander", "we", "us") governing your use of the oleander platform, APIs, MCP endpoints, and integrations, including integrations installed through third-party marketplaces such as the Vercel Marketplace (collectively, the "Service").
By installing an oleander integration or using the Service, you agree to this Agreement. If you do not agree, do not install or use the Service.
1. License Grant
Subject to this Agreement, oleander grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
2. Restrictions
You may not:
- Copy, modify, or create derivative works of the Service except as permitted by law or by open source licenses that apply to components of the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by law;
- Resell, sublicense, or otherwise make the Service available to third parties except as expressly permitted;
- Use the Service to violate any applicable law or the rights of any third party;
- Circumvent usage limits, rate limits, or security controls of the Service.
3. Accounts and API Keys
You are responsible for safeguarding the credentials and API keys issued to your organization, including keys provisioned into third-party platforms such as Vercel projects. You are responsible for activity that occurs under your credentials. You can revoke API keys at any time from your oleander settings, and uninstalling a marketplace integration revokes the keys it provisioned.
4. Your Data
You retain all rights to the data you submit to the Service. You grant oleander a limited license to host, process, and display that data solely to provide the Service. Our collection and use of personal information is described in our Privacy Policy.
5. Third-Party Services
The Service interoperates with third-party platforms, including Vercel. Your use of those platforms is governed by their own terms, and oleander is not responsible for third-party services. Environment variables created in your projects by an oleander integration are provided for your use of the Service.
6. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLEANDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OLEANDER'S TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNTS YOU PAID TO OLEANDER FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Termination
This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the integration and discontinuing use of the Service. oleander may suspend or terminate your access if you materially breach this Agreement. Sections 4 through 7 survive termination.
9. Changes to this Agreement
We may update this Agreement from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.
